      based.&nbsp; As explained in more detail below, this omission is=20
      significant because to recover damages for breach of a contract as =
a=20
      matter of law, the movant must establish the amount of damages =
flowing=20
      from the breach. In this case, the part of the lease agreement =

      from our record contains terms regarding early termination of the =

      summary-judgment evidence shows that the Bank One Entities had =
knowledge=20
      of the truck</SPAN><SPAN=20
      style=3D"FONT-SIZE: 13pt; LINE-HEIGHT: 150%; FONT-FAMILY: 'WP =
TypographicSymbols'">=3D</SPAN><SPAN=20
      style=3D"FONT-SIZE: 13pt; LINE-HEIGHT: 150%">s whereabouts or its =
odometer=20
      reading.&nbsp; Therefore, the Bank One Entities have no way of =
knowing the=20
      amount of mileage on the truck to calculate any applicable mileage =

      penalty.&nbsp; Based on the summary-judgment evidence and the =
parts of the=20
      lease the Bank One Entities did attach to their motion, Tello =
would owe=20
      only $9,870 (21 monthly payments of $470) plus a $350 return =
fee.&nbsp;=20
      Nonetheless,&nbsp; the trial court awarded the Assignee in excess =
of=20
      $29,000 in actual damages, even though this amount is not =
supported by the=20
      part of the contract contained in the summary-judgment evidence =
and even=20
      though the missing parts of the lease (like certain parts of it =
that=20
