      appeals from a take-nothing summary judgment, rendered in favor of =

      appellees, Michael and Carolee Cote, disposing of Herrington's =

      liability suit. We determine whether the trial court erred in (1) =
denying=20
      Herrington's objections both to the Cotes' reply to her summary =
judgment=20
      response and their objections to Herrington's summary judgment =
evidence as=20
      untimely, (2) denying Herrington's objections to the Cotes' =
summary=20
      judgment evidence as self-serving, (3) granting the Cotes' motion =
for=20
      summary judgment on traditional and no-evidence grounds, and (4) =
denying=20
      Herrington's motion for rehearing or motion for new trial. We also =

      determine whether Herrington preserved her challenge that the =
Cotes'=20
      summary judgment evidence was contradictory and controverted. We =
affirm.=20

      Charles Allen Herrington, a minor child, was riding his bicycle on =

      Cotes' property. As Charles rode his bicycle out of the Cotes' =
driveway=20
      and into the street, he collided with the side of a car driven by =
Jennifer=20
      Morgan. Charles sustained severe injuries. Herrington, Charles's =
mother,=20
      as next friend of Charles, brought a premises liability action =
sounding in=20
      negligence against the Cotes for Charles's injuries, claiming that =
shrubs=20
      planted along the Cotes' driveway from the garage to the edge of =
the=20
      street created a dangerous condition that obstructed Charles's =
ability to=20
      see oncoming traffic, which was a direct and proximate cause of =
his=20
      injuries.</SPAN><SPAN=20

      the Cotes filed a motion for summary judgment, on both traditional =

      no-evidence grounds, claiming that they owed no duty to Charles =
and there=20
      was no evidence that they (1) owed a duty to Charles, (2) breached =
such a=20
      duty, or (3) proximately caused Charles's injuries. On August 21, =
2002,=20
      Herrington objected to the Cotes' affidavits as self-serving and =
asked=20
      that they be struck as summary judgment proof. On August 22, 2002, =

      Herrington responded to the Cotes' motion for summary judgment. On =
August=20
      30, 2002, the Cotes countered with their own objections to =
evidence=20
      supporting Herrington's summary judgment response, requesting that =
the=20
      affidavits of Virginia and Suzanne Elkins, the Cotes' next door =
neighbors,=20
      be struck and arguing that, if they were not struck, the =
affidavits should=20
      be held insufficient as a matter of law. </SPAN></P>
      <P><SPAN=20

      Cotes' motion for summary judgment was held at 8:00 a.m. on =
September 3,=20
      2002. Later that same day, at 4:30 p.m., the Cotes served their =
reply to=20
      Herrington's summary judgment response by fax. </SPAN><SPAN=20
      style=3D"FONT-SIZE: 10pt; FONT-FAMILY: Times New =
Roman"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 10pt; FONT-FAMILY: Times New =
Roman"></SPAN><SPAN=20

      2002, Herrington filed an objection to the Cotes' reply =

      trial court granted summary judgment in favor of the Cotes. =

Roman"></SPAN></P>
      <P align=3Dcenter><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman"><STRONG>Timeliness=20
      of the Cotes' Reply and Objections</STRONG></SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">In her=20
      first issue presented for review, Herrington contends that the =
trial court=20
      should not have considered the Cotes' reply to her summary =
judgment=20
      response or their objections to her summary judgment evidence =
because both=20
      were untimely filed pursuant to rules 21, 21(a), and 166a of the =
Texas=20
      Rules of Civil Procedure. Herrington asserts that the Cotes should =
have=20
      filed their reply and objections at least three days before the =
summary=20
      judgment hearing. Herrington contends that, because she did not =
receive=20
      the Cotes' reply and objections until after the summary-judgment =
hearing,=20
      the trial court should not have considered those items.</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman"><STRONG>A.=20
      Reply</STRONG> </SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">Rule 166a=20
      establishes the procedures for summary judgment proceedings. Rule =
166a(c)=20
      sets a deadline of seven days prior to the summary judgment =
hearing as a=20
      time limit for additional documents to be filed. Tex. R. Civ. P. =
166a(c);=20
      <EM>Knapp v. Eppright</EM>, 783 S.W.2d 293, 296 (Tex. =
App.--Houston [14th=20
      Dist.] 1989, no pet.). This seven-day limit applies only to the =
response=20
      of the non-movant to the summary judgment motion. <EM>Knapp</EM>, =
783=20
      S.W.2d at 296. Rule 166a(c) does not impose a deadline by which =
the reply=20
      of the moving party to the summary judgment response must be =
filed.=20
      <EM>Id</EM>.; <EM>Shelton v. Sargent</EM>, 144 S.W.3d 113, 119 =
(Tex.=20
      App.--Fort Worth 2004, pet. denied). Here, the Cotes moved for =
summary=20
      judgment, and their reply to Herrington's response to their motion =
for=20
      summary judgment is not governed by the seven-day requirement of =
rule=20
      166a(c). <EM>See </EM>Tex. R. Civ. P. 166a(c).</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">Therefore,=20
      the trial court did not err in overruling Herrington's objection =
to the=20
      Cotes' reply to Herrington's response to their motion for summary=20
      judgment.</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman"><STRONG>B.=20
      Objections</STRONG></SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">The=20
      timeliness of the Cotes' objections to Herrington's summary =
judgment proof=20
      is governed by Texas Rule of Evidence 21, which provides, in =
relevant=20
      part:</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">Every . . .=20
      application for an order . . . shall be filed with the clerk of =
the court=20
      in writing, shall state the grounds therefor, shall set forth the =
relief=20
      or order sought, and at the same time a true copy shall be served =
on all=20
      other parties, and shall be noted on the docket. An application to =
the=20
      court for an order . . . shall be served upon all other parties =
not less=20
      than three days before the time specified for the hearing unless =
otherwise=20
      provided by these rules or shortened by the court.</SPAN></P><BR=20
      WP=3D"BR1"><BR WP=3D"BR2">
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">Tex. R.=20
      Civ. P. 21.</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">Herrington=20
      contends that she received the Cotes' objections to her summary =
judgment=20
      evidence later the same day of the summary judgment hearing. The =
record,=20
      however, reflects that the Cotes' objections were filed and =
delivered to=20
      Herrington on August 30, 2002, four days before the hearing. As a =
result,=20
      the trial court did not err in denying Herrington's objection to =
the=20
      Cotes' objections to her summary judgment evidence on the basis of =

      untimeliness. </SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">We overrule=20
      Herrington's first issue.</SPAN></P>
      <P align=3Dcenter><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman"><STRONG>Affidavits</STRONG></SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">In her=20
      second issue, Herrington contends that the trial court erred in =
denying=20
      her objections to the Cotes' affidavits because the affidavits =
constituted=20
      self-serving testimony that was neither free from contradiction =
nor=20
      uncontroverted. </SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman"><STRONG>A.=20
      Self-Serving</STRONG></SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">The first=20
      prong of Herrington's argument is that the Cotes' affidavits were=20
      self-serving and thus should not have been considered as proper =
summary=20
      judgment evidence. Herrington objected below that the Cotes' =
affidavits=20
      were self-serving, and the trial court overruled Herrington's =
objections.=20
      </SPAN><SPAN=20
      style=3D"FONT-SIZE: 10pt; FONT-FAMILY: Times New =
Roman"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">However, =
the mere=20
      fact that affidavits are self-serving does not necessarily make =
the=20
      evidence an improper basis for summary judgment. <EM>Trico Techs. =
Corp. v.=20
      Montiel</EM>, 949 S.W.2d 308, 310 (Tex. 1997).<EM> </EM>Summary =
judgment=20
      based on the uncontroverted affidavit of an interested witness is =
proper=20
      if the evidence is clear, positive, direct, otherwise credible, =
free from=20
      contradictions and inconsistencies, and could have been readily=20
      controverted. <EM>Republic Nat'l Leasing Corp. v. Schindler</EM>, =
717=20
      S.W.2d 606, 607 (Tex. 1986); <EM>see </EM>Tex. R. Civ. P. 166a(c). =
Because=20
      Herrington did not object below that the Cotes' affidavits were=20
      controverted, unclear, not positive, indirect, otherwise =
incredible, or=20
      not capable of being readily controverted, the ways in which a=20
      self-serving affidavit can be attacked, the trial court correctly=20
      overruled Herrington's objection to their self-serving nature.=20
      Accordingly, we overrule that portion of Herrington's argument on =
appeal=20
      that was preserved by trial objection, <EM>i.e.</EM>, her =
complaint that=20
      the Cotes' affidavits were self-serving.</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman"><STRONG>B.=20
      Contradictory and Controverted</STRONG></SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">In the=20
      second prong of her argument, and for the first time on appeal, =
Herrington=20
      complains that the Cotes' affidavits were neither free from =
contradiction=20
      nor uncontroverted.<A=20
      =
href=3D"http://www.1stcoa.courts.state.tx.us/opinions/htmlopinion.asp?Opi=

      (2)</SUP></A> Rule 166a(c) provides that "[i]ssues not expressly =
presented=20
      to the trial court by written motion, answer or other response =
shall not=20
      be considered on appeal as grounds for reversal." Tex. R. Civ. P =
166a(c).=20
      Rule 166a(f) provides that "[d]efects in the form of affidavits or =

      judgment proof sufficient to raise a fact issue as to whether the =
Cotes=20
      knew of a dangerous condition, unknown to Charles, and failed to =
warn him=20
      of it or to make the condition safe. </SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">A =
dangerous=20
      condition is one that creates a substantial risk of injury when =
the=20
      property is used with due care in a manner in which it is =
reasonably=20
      foreseeable that it will be used. <EM>See</EM> Black's Law =
Dictionary 394=20
      (6th ed.1990). For example, it is generally foreseeable that a =
floor will=20
      be walked on, and, thus, a condition of the floor that creates a=20
      substantial risk of injury to those walking in a careful manner on =
it is=20
      foreseeable. <EM>Knorpp</EM>, 981 S.W.2d at 474. In the present =
case,=20
      however, Herrington has not provided any evidence to show that it =
was=20
      reasonably foreseeable that the Cotes' driveway would be used by a =
child=20
      riding a bicycle so that the shrubs on the side of their driveway =
would=20
      become a dangerous condition</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">. <EM>See=20
      id</EM>.</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">The primary=20
      evidence upon which Herrington relies to create a fact issue is =
from the=20
      affidavits of Virginia and Suzanne Elkins, next door neighbors of =
the=20
      Cotes. They stated that children routinely rode their bicycles and =

      skateboards in the Cotes' driveway and that the shrubs would make =
it=20
      difficult to see a boy riding his bicycle from the Cotes' driveway =
into=20
      the street. However, the Cotes objected to the Elkinses' =
affidavits, and=20
      the trial court's order sustained the Cotes' objections, thereby =
rendering=20
      the affidavits unavailable for summary judgment proof. Herrington =
does not=20
      complain of this evidentiary ruling on appeal.</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">Herrington=20
      also relies on her testimony that the Cotes had given Charles =
permission=20
      to walk across their yard because of the absence of sidewalks, but =
this=20
      does not supply any proof that the Cotes should have reasonably =
foreseen=20
      that Charles would ride his bicycle in their driveway. =
</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">Herrington =
further=20
      relies on <EM>Fetty v. Miller </EM>to support her contention that =
the=20
      Cotes should have reasonably anticipated or foreseen that a child, =
such as=20
      Charles, riding his bicycle in their driveway might not be able to =
see=20
      oncoming traffic. <EM>Id.</EM>, 905 S.W.2d 296 (Tex. App.--San =
Antonio=20
      1995, writ denied). In <EM>Fetty</EM>, a driver involved in an =
accident at=20
      an intersection brought suit against a landowner who had two =
parked=20
      vehicles on his front lawn, which the plaintiff claimed obstructed =
his=20
      view of oncoming traffic at the intersection. <EM>Id. =
</EM>However, the=20
      court held that the landowner could not have reasonably foreseen =
that his=20
      parked vehicles would create a hazardous condition. <EM>Id. =
</EM>The court=20
      concluded that the harm was unforeseeable based on the fact that =
the=20
      defendant had parked his vehicles in front of his home for nine =
years,=20
      during which time no one had complained and no accidents had =
occurred.=20

      reasonably anticipated that a child such as Charles would be =
injured by=20
