      Leta Mitchell appeal the trial court's grant of a take-nothing =
judgment=20
      and award of attorneys' fees in favor of Arturo Garza. In three =
issues,=20
      the Mitchells contend that the trial court erred in (1) refusing =
to=20
      declare the existence of an easement by estoppel, (2) refusing to =
issue a=20
      permanent injunction to remove the fence that interferes with =
their=20
      easement, and (3) denying their request for attorneys' fees. We =
affirm.=20
      </SPAN></P>
      <P align=3Dcenter><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman"><STRONG>Background</STRONG></SPAN></P>
      <P><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman"><STRONG></STRONG>The=20
      Mitchells purchased the house located at 7823 Capitol ("the =
Mitchell=20
      property") in 1959. Robert's mother and stepfather had been living =
in the=20
      house since at least 1954 and continued to do so after the =
Mitchells'=20
      acquisition. A single, shale-covered driveway was located between =
the=20
      Mitchell property and the adjacent house at 7827 Capitol ("the =
adjacent=20
      property"). In order to use their portion of the driveway, the =
Mitchells=20
      believe that they had to use part of the driveway on the adjacent=20
      property.</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">Robert's=20
      mother and stepfather continued to live in the Mitchell property =
until=20
      Robert's mother died and his stepfather was moved to a nursing =
home. For a=20
      couple of years after that, Robert's step-grandfather lived in the =
house=20
      and also used the driveway. When Robert's step-grandfather died, =
tenants=20
      began occupying the Mitchell property. Around 1980, the Mitchells =
stopped=20
      renting the Mitchell property, and it was vacant. While vacant, =
the=20
      Mitchells often visited to make repairs, and,</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> in 1986, =
they began=20
      storing furniture in the house. They generally made monthly trips =
to the=20
      Mitchell property with six months being the longest period without =
a=20
      visit</SPAN><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">.=20
      Also, at one point, the owner of the adjacent property had a =
portion of=20
      the driveway asphalted, during which some asphalt spilled over and =
covered=20
      a portion of the driveway on the Mitchell property.</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">In 1989,=20
      the City of Houston replaced the curb in front of the Mitchell =
property.=20
      In the process of replacing the curb, the City neglected to leave =
an=20
      opening to the driveway. The Mitchells wrote a letter requesting =
that the=20
      City fix the curb opening to the driveway. Soon thereafter, the =
City=20
      restored the opening.</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">Garza lived=20
      in the neighborhood since 1988 and bought the adjacent property in =
2002.=20
      He testified that he thought the Mitchell property was abandoned =
because=20
      the "the grass [was] high" and he "hardly" saw anyone there. Garza =
also=20
      testified that, when he did see people at the Mitchell property, =
they were=20
      parked on the street. He indicated that he never talked to anyone =
that=20
      lived at the Mitchell property about their using the part of the =
driveway=20
      that was located on his property. Around 2003, Garza built a chain =
link=20
      fence on his portion of the driveway. The fence left the Mitchells =
unable=20
      to drive a vehicle to the back of the Mitchell property or to open =
a car=20
      door when parked between the house and the fence. The Mitchells =
cannot=20
      legally park on the street because of a nearby fire hydrant and =
also=20
      cannot legally park in the front of the driveway because they =
would be=20
      partially on the sidewalk. Around 2005, the Mitchells began =
renting out=20
      the Mitchell property again, and their tenants, as of the time of =
trial,=20
      were parking on the sidewalk. </SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">The=20
      Mitchells filed suit against Garza, seeking declaratory and =
injunctive=20
      relief. Specifically, the Mitchells argued that, because they have =
used=20
      the driveway for more than 50 years, they acquired an easement on =
the=20
      driveway, either by prescription, express grant, implication, =
necessity,=20
      or estoppel. They alleged that by installing the fence on the =
driveway,=20
      Garza trespassed onto and violated their use and enjoyment of the=20
      easement. The Mitchells sought to have the trial court declare the =

      existence of the easement and issue an injunction mandating that =
Garza=20
      permanently remove the fence. Following a bench trial, the trial =
court=20
      entered a take-nothing judgment on the Mitchells' claims for =
relief. The=20
      Mitchells now appeal. <STRONG></STRONG></SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =

      <CENTER>Easement by Estoppel</CENTER></STRONG></SPAN>
      <P></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">In issue=20
      one, the Mitchells argue that the trial court erred in refusing to =
declare=20
      the existence of an easement by estoppel. Specifically, the =
Mitchells=20
      argue that the evidence demonstrated their entitlement to an =
easement by=20
      estoppel and the trial court erred by not entering a judgment =
declaring=20
      the existence of such an easement. We=20
disagree.<STRONG></STRONG></SPAN></P>
      <P><SPAN=20

      Review</STRONG></SPAN></P>
      <P><SPAN=20

      a nonjury trial, where no findings of fact or conclusions of law =
are filed=20
      or requested, the trial court's judgment implies all findings =
necessary to=20
      support it, provided the necessary findings are raised by the =
pleadings=20

      the Mitchells must show that the trial court's judgment cannot be=20
      sustained by any theory raised by the evidence. =

      2001)). A matter-of-law challenge requires us first to examine the =
record=20
      for evidence that supports the finding, while ignoring all =
evidence to the=20
      contrary. <EM>Id.</EM> If no evidence supports the finding, we =
will then=20
      examine the entire record to determine if the contrary proposition =
is=20
      established as a matter of law. <EM>Id.</EM> We will sustain the=20
      matter-of-law challenge only if the contrary proposition is =
conclusively=20
      established. <EM>Id.</EM></SPAN><SPAN=20

      party attacks the factual sufficiency of an adverse finding on an =
issue on=20
      which he has the burden of proof, he must demonstrate on appeal =
that the=20
      adverse finding is against the great weight and preponderance of =
the=20
      evidence. </SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"><EM>Dow =
Chem.</EM>,=20
      46 S.W.3d at 242.</SPAN><SPAN=20

consider and=20
      weigh all of the evidence and can set aside a verdict only if the =
evidence=20
      is so weak or if the finding is so against the great weight and=20
      preponderance of the evidence that it is clearly wrong and unjust. =

      doing so, the court of appeals must "detail the evidence relevant =

      establish the existence of an easement by estoppel, sometimes =

      <EM>estoppel in pais</EM>, the Mitchells had the burden of proving =

      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> =
1988</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> and =
purchased the=20
      adjacent property in 2002, but had</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> only =
occasionally=20
      seen the Mitchells at </SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">the =
Mitchell=20
      property</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> and was =
not aware=20
      that they or their predecessors were using the =
driveway</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">. He=20
      assumed</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> the house =
was=20
      abandoned due to its unkempt lawn and infrequency of =
visitors</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">. This is =
legally=20
      sufficient evidence to support the implied finding that Garza was =
a=20
      purchaser for value without notice of the Mitchells' easement. =
</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">We also=20
      must determine if there is evidence that an easement by estoppel =
was=20
      created during Garza's ownership of the adjacent property. The =
Mitchells=20
      testified that they never discussed their use of the driveway with =
anyone.=20
      Likewise, Garza testified that he never talked with anyone from =
the=20
      Mitchell property about using the driveway. Furthermore, no one =
complained=20
      when Garza was installing the fence, which Leta Mitchell admitted =
was=20
      properly placed on Garza's property line. We hold that there was =
legally=20
      sufficient evidence to support the trial court's implied finding =
that an=20
      easement by estoppel was not established while Garza was the =
adjacent=20
      property's owner. </SPAN></P>
      <P><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">We must =
now consider=20
      whether there was factually sufficient evidence that Garza did not =
have=20
      notice of any existing easement when he purchased the adjacent=20
      property.</SPAN><SPAN=20

      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> Garza =
testified=20
      that he has lived in the neighborhood since 1988. In 1989, =
t</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">he =
Mitchells were=20
      successful in having the City of Houston restore the curb opening =
to the=20
      driveway </SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">after =
</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">the City =
paved a=20
      curb that blocked </SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">their =
access to the=20
      Mitchell property</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">'s</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> driveway. =

      </SPAN><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: =
Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">Furthermore, Leta=20
      testified that they generally made monthly trips to the Mitchell =
property,=20
      with six months being the lo</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">ngest =
period without=20
      a visit. They continued to make repairs to the Mitchell property,=20
      including the installation of siding in 1992 and new pipes =
beginning in=20
      2001. The Mitchells also contend that the asphalt, which covers a =
portion=20
      of their driveway, is proof of a common use of the =
driveway</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">.<A=20
      =

      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> only =
occasionally=20
      seen the Mitchells at </SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">the =
Mitchell=20
      property</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">, and he =
was not=20
      aware that they or their predecessors were using the =
driveway</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">. During =
the years=20
      when</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> =
</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">the =
Mitchell=20
      property</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> was being =
repaired=20
      and used for furniture storage, the driveway was not used by the=20
      M</SPAN><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: =
Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">itchells =
each time=20
      they visited, and</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> they =
often parked=20
      on the street. Garza also testified that he believed the Mitchell =
property=20
      was abandoned because of its unkempt lawn and infrequency of =
visitors.=20
      Garza testified that the previous owner of the adjacent property =
poured=20
      the asphalt, and, when he bought the adjacent property, the seller =
told=20
      him that the driveway belonged to the adjacent property. We hold =
that=20
      there is factually sufficient evidence to support the trial =
court's=20
      implied finding that Garza lacked actual or constructive notice of =
the=20
      Mitchells' alleged easement by estoppel. </SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman"></SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">We next=20
      determine if there is factually sufficient evidence to support the =
trial=20
      court's implied finding that the Mitchells did not acquire an =
easement by=20
      estoppel while Garza owned the adjacent property. To have an =
easement by=20
      estoppel, the Mitchells had the burden of proving that Garza =
communicated=20
      a representation, either by words or conduct, to them indicating a =
right=20
      to use the driveway and that the Mitchells believed in and relied =
on the=20
      communication. <EM>See Storms</EM>, 579 S.W.2d at 452</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">. The =
evidence shows=20
      that the Mitchells never had a conversation with Garza concerning =
their=20
      use of the driveway. </SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">However,=20
      acquiescing behavior or the failure to object by a servient estate =
may be=20
      conduct that gives rise to a representation, if the dominant =
estate relied=20
      on this conduct in a way that should preclude the servient estate =
from=20
      denying it. <EM>See Wallace v. McKinzie</EM>, 869 S.W.2d 592,=20
      595</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">-</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">96 (Tex.=20
      App.--Amarillo 1993, writ denied)</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">.</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> Thus, we =
look to=20
      see whether any acquiescence or failure to object on Garza's part=20
      represented a right to use the driveway and, if so, whether the =
Mitchells=20
      believed in and relied on any such representation.</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">After Garza=20
      bought the adjacent property in 2002, the Mitchells continued to =
repair=20
      and fix-up the Mitchell property. Garza testified that he =
sometimes came=20
      home from work early and saw the Mitchells at the Mitchell =
property.=20
      However, before the fence was erected, when they were =
visiting</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">, the =
Mitchells=20
      usually parked in the street or in the front of the driveway, not =
in the=20
      driveway. </SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">Th</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">e =
Mitchells'=20
      daughter, Carol Hughes, asked&nbsp;</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman">Garza to =
move his=20
      vehicles when they were blocking the driveway. Garza moved his =
vehicles=20
      once, and he actually drove Carol's car around his vehicles once, =
but he=20
      did not move his vehicles the third time he was asked.</SPAN><SPAN =

      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> The =
evidence is=20
      factually sufficient to support the trial court's implied finding =
that=20
      Garza's behavior did not represent to the Mitchells a right to use =
the=20
      driveway. Because we hold that a right to use the driveway was not =

      represented to the Mitchells, we need not address whether they =
believed in=20
      and relied on such a representation.</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Verdana"></SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New Roman"> =
</SPAN></P>
      <P><SPAN style=3D"FONT-SIZE: 14pt; FONT-FAMILY: Times New =
Roman">The=20
      evidence is not so contrary to the trial court's take-nothing =
judgment as=20
      to render that judgment clearly wrong or unjust. Accordingly, we =
hold that=20
      the trial court did not err in refusing to grant the Mitchells an =
easement=20
      by estoppel, and we overrule the Mitchells' first issue. Having =
overruled=20
      issue one, we need not address issues two and three.</SPAN></P>
