      Raymon Poland was the husband of Jessie Poland; the remaining =
appellants=20
      were his natural children. In August 2003, Jessie Poland, under =
the care=20
      of Dr. James Willerson (an appellee in a related appeal) and Dr. =
Ott, was=20
      hospitalized at St. Luke=E2=80=99s Episcopal Hospital and the =
Texas Heart=20
      Institute (both appellees in another related appeal) for an =
elective=20
      surgical procedure to repair her heart=E2=80=99s mitral valve. Dr. =
Alina Grigore,=20
      who was employed by Dr. Arthur S. Keats &amp; Associates (both of =
whom are=20
      appellees in another related appeal), was the anesthesiologist for =
the=20
      surgical procedure. The Poland parties alleged that, at the time =
of=20
      surgery, Jessie Poland=E2=80=99s blood contained a level of =
Coumadin that the=20
      health-care providers should have known rendered her blood fully=20
      anti-coagulated and, thus, rendered surgery dangerous. The surgery =
was=20
      nonetheless performed; Jessie Poland bled internally; and she died =
several=20
      days later of multi-system organ failure.</SPAN></SPAN></P>

      death, for her pain and suffering and medical costs before her =

      for her burial expenses. By the time of the trial court=E2=80=99s =
complained-of=20
      ruling, the Poland parties had amended their petition to allege =
the=20
      following causes of action or theories of recovery against all =
defendants,=20

result of the=20
      Poland parties=E2=80=99 interpretation in this case is that Dr. =
Ott could never=20
      have timely filed an objection to the expert report with the court =
because=20
      the 21-day deadline to do so would have expired before a =
proceeding=20
      existed in which that objection could have been filed</SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt">. Simply put, the 21-day deadline for a=20
      defendant=E2=80=99s objections makes no sense unless a court claim =

      even knowing if they will be sued at all. The Legislature surely =
did not=20

      an interpretation would contravene the Legislature=E2=80=99s =
intent in adopting=20
      former section 74.351(a), we do not deem the Legislature to have =
intended=20

      enclosed in some sort of packaging, but nothing in the letter said =
by what=20
      means the enclosed documents were delivered to McLeod. The letter =
then=20
      stated that counsel would =E2=80=9Cfax some additional =
information=E2=80=9D to McLeod, but=20
      the =E2=80=9Cadditional information=E2=80=9D was not specified. =
Furthermore, counsel=E2=80=99s=20
      affidavit merely averred that she =E2=80=9Creplied . . . by =
sending=E2=80=9D the report=20
      and CV<I> </I></SPAN><SPAN style=3D"FONT-SIZE: 14pt">to McLeod, =
without=20
      stating how the =E2=80=9Csending=E2=80=9D occurred. </SPAN><SPAN=20
      style=3D"FONT-SIZE: 14pt">None of this evidence demonstrated that =
the Poland=20
      parties served the required items by one of the four methods set =
out in=20
      rule 21a. Service by methods other than those enumerated in rule =
21a does=20
      not comply with section 74.351(a)=E2=80=99s service requirement. =
