      The Cadle Company (=E2=80=9CCadle=E2=80=9D), appeals the summary =
judgment rendered in=20
      favor of appellee, Roy H. Bray, that collaterally attacked and =
declared=20
      void a default judgment against Bray in an earlier case involving =
the same=20
      two parties. Cadle contends that the trial court improperly =
granted=20
      summary judgment because (1)&nbsp;Cadle=E2=80=99s petition to =
revive the dormant=20
      judgment that led to the default was a properly filed =
=E2=80=9Caction of debt=E2=80=9D;=20
      (2)&nbsp;the Harris County Court at Law had subject-matter =
jurisdiction=20
      over Cadle=E2=80=99s petition to revive the judgment underlying =
the default=20
      judgment; and (3)&nbsp;the claims brought by Bray are barred by =
res=20
      judicata. We conclude that County Court at Law No. 1 had =
subject-matter=20
      jurisdiction to render the default judgment and the remainder of =

      challenges are barred by res judicata. We reverse and render =

      Note and Liens, covering a promissory note in the amount of =
$90,000.=20
      <I>Id.</I> When Bray failed to pay the fourth quarter interest, =

      Bank sought full payment on the note. <I>Id.</I> The Federal =
Deposit=20
      Insurance Corporation (=E2=80=9CFDIC=E2=80=9D) became the receiver =
of the note when=20
      Security Bank ceased operating. <I>Id.</I> The FDIC sold all of =
Security=20
      Bank=E2=80=99s notes, including both Bray=E2=80=99s note and the =
note securing Bray=E2=80=99s=20

      Although the petition showed that jurisdiction was proper in =

      Court at Law No.&nbsp;1, the clerk assigned the case to Harris =
County=20
      Court at Law No.&nbsp;3. Bray was served but did not answer. =
Subsequently,=20
      the Harris County Administrative Judge transferred the case to =
Harris=20
      County Court at Law No.&nbsp;1. In the order transferring the =
case, the=20
      administrative judge stated, =E2=80=9CPursuant to the local rules, =
[cause number=20
      829,990] previously filed in court 579,602 [sic] under docket =
number 1=20
      [sic], is transferred to the County Court at Law No. One, Harris =
County=20
      Texas.=E2=80=9D Harris County Court at Law No.&nbsp;1 granted a =
default judgment=20
      in favor of Cadle on August 25, 2005. In the default judgment, the =
trial=20
      court revived the underlying 1993 judgment and awarded Cadle =
$71,191.38,=20
      which was the amount of the original judgment plus interest. The =
default=20
      judgment noted that Bray was =E2=80=9Cduly and legally cited to =
appear and=20
      answer,=E2=80=9D but he defaulted by failing to appear and =
answer.</SPAN></P>

14pt"><SPAN>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<=

      November 11, 2005, Bray filed this suit against Cadle, seeking a=20
      declaratory judgment that the default judgment reviving the 1993 =
judgment=20
      was void for three reasons. First, Bray contended that the default =

      judgment was void because County Court at Law No.&nbsp;3 did not =
have=20
      subject matter jurisdiction to revive the 1993 judgment, which was =

      rendered by County Court at Law No.&nbsp;1. Bray explained that =
the suit=20
      to revive filed by Cadle was not an action of debt, since it =
sought only=20
      to revive the underlying 1993 judgment, and that it was instead an =
action=20
      for <I>scire facias</I>, over which County Court at Law No.&nbsp;1 =
had=20
      exclusive jurisdiction. Bray stated further that the transfer of =
the case=20
      to County Court at Law No.&nbsp;1 did not give that court =
jurisdiction to=20
      hear the matter =E2=80=9Csince jurisdiction is determined at the =
time the suit is=20
      filed.=E2=80=9D Second, Bray pleaded that the default judgment was =
void because=20
      County Court at Law No.&nbsp;1 lacked personal jurisdiction over =
Bray.=20
      Specifically, Bray stated that he =E2=80=9Cwas never served with a =
citation or=20
      petition showing that the cause number 829,990 was filed=E2=80=9D =
in County Court=20
      at Law No.&nbsp;1. Bray contended that the citation and petition =
in County=20
      Court at Law No.&nbsp;3 were nullities. Third, Bray asserted that =
the=20
      default judgment was unsupported by the pleadings. Bray explained =
that the=20
      petition in cause number 829,990 is not an action of debt since =
only costs=20
      of court were requested, and that the default judgment is not =
supported by=20
      Cadle=E2=80=99s pleadings. Cadle answered denying Bray=E2=80=99s =
claims and pleading the=20
      affirmative defenses of estoppel, laches, and res judicata. By =
agreement=20
      of the parties, this suit seeking the declaratory judgment was =
transferred=20
      from County Court at Law No. 3 to County Court at Law=20

      judgment for that claim. The record further undisputedly shows =
that Cadle=20
      attempted to have the case filed in County Court at Law No. 1 by =
stating=20
      in its petition that jurisdiction was proper in County Court at =
Law No. 1=20
      due to the judgment that was previously rendered in that court. =
Cadle,=20
      therefore, attempted to have the case assigned to the court that =
rendered=20
      the prior judgment. Bray contends that we must determine whether =
there is=20
      subject matter jurisdiction at the time the case is filed. =
However, it is=20
      undisputed that County Court at Law No.&nbsp;1 had jurisdiction at =
the=20
      time the case was filed because the prior judgment was issued in =
that=20
      court.</SPAN></P>

      challenge by Bray is narrow. Bray claims that because =
Cadle=E2=80=99s suit to=20
      revive was <I>assigned</I> by the county clerk to County Court at =
Law No.=20
      3 instead of County Court at Law No. 1, where the <I>scire facias=20
      </I>claim belonged, that County Court at Law No. 1 never properly =
had=20
      jurisdiction over the claim, despite the transfer by the =
administrative=20
      judge, who ordered the claim transferred from County Court at Law =
No. 3 to=20
      County Court at Law No. 1. Assuming that the claim was for =
<I>scire=20
      facias</I> as Bray asserts and that the <I>scire facias</I> claim =
had to=20
      be resolved in the same court that issued the underlying judgment, =
we=20
      cannot conclude that the initial assignment of the case in County =
Court at=20
      Law No. 3 rather than County Court at Law No. 1, the latter being=20
      expressly referred to in the petition, deprives County Court at =
Law=20
      No.&nbsp;1 of subject matter jurisdiction. </SPAN></P>

      ref=E2=80=99d). We disagree. The circumstances in <I>Cashion</I> =
concern a bill of=20
      review, but are procedurally similar to those here. <I>See id.</I> =

      <I>Cashion</I>, the plaintiff=E2=80=99s petition contained a =
caption that named=20
      both the plaintiff and defendant, bore the address =E2=80=9CIn the =
14th Judicial=20
      District, Dallas County, Texas,=E2=80=9D and was handed to the =
district clerk with=20
      the oral statement that it was being filed in the 14th District =
Court, but=20
      the clerk instead assigned the petition a number that belonged to =
the=20
      116th District Court. <I>Id.</I> The 116th District Court entered =
an order=20
      purporting to transfer Cashion=E2=80=99s cause to the 14th =
District Court.=20
      <I>Id.</I> The 14th District Court issued the citation for =
Cashion=E2=80=99s cause=20
      and, after the defendant answered, sustained the =
defendant=E2=80=99s general=20

of the=20
      cause after the case was transferred by continuing to name County =
Court at=20
      Law No. 3 in the captions of the motions it filed, and =
(3)&nbsp;allowed=20
      the case to be dismissed for want of prosecution.</SPAN> <A=20

      filled in with the information for County Court at Law No. 1. But, =

      noted above, within the petition was a statement that the case =
would be=20
      properly assigned to County Court at Law No. 1. We agree with the=20
      reasoning of <I>Cashion</I> that a plaintiff=E2=80=99s petition =
that includes a=20
      statement concerning the proper court for the case to be assigned =
is=20
      sufficient to show the plaintiff=E2=80=99s intent concerning the =
court to which=20
      the case should be assigned. <I>See id.</I> We also agree with the =

      reasoning of <I>Cashion</I> that the transferee court did not lose =

      subject-matter jurisdiction merely because it received the case by =

      transfer from another court of concurrent jurisdiction within the =
same=20
      county. <I>See id.</I></SPAN></P>

      of section 74.121 specifically provides that these courts may =
transfer=20
