2005, Judy Beam was arrested and charged with a misdemeanor offense. =
Pursuant to=20
a plea agreement, the charge was later dismissed and Beam was granted =
deferred=20
adjudication on the lesser charge of disorderly conduct. <SPAN=20
style=3D"TEXT-TRANSFORM: uppercase">Tex. Penal Code</SPAN> =A7 42.01(a). =
On February=20
16, 2006, less than two years later, Beam filed a petition for =
expunction=20
pursuant to article 55.01 of the Code of Criminal Procedure. The State =
contends=20
that Beam is not entitled to expunction until two years after the date =
on which=20
she allegedly committed the misdemeanor offense because the State has a =
two-year=20
limitations period during which it may present an indictment or=20
information.<SPAN style=3D"TEXT-TRANSFORM: uppercase"> Code Crim. =

We agree with the State. </P>

Legislature amended article 55.01(a) in 2001, however, courts of appeals =

differed as to the correct interpretation of the statute. The Amarillo =
and El=20
Paso courts of appeals have held that because article 55.01(a)(2)(A) =
applies=20
only to felonies, article 55.01(a)(2)(A)(i)=92s limitations requirement =
applies=20

supports the=20
Dallas court of appeals=92 view that the limitations requirement of =

55.01(a)(2)(A)(i) applies to both felonies and misdemeanors. Paragraph =

authorizes expunction for felonies and misdemeanors only if =
=93<I>each</I> of the=20
following conditions exist,=94 and then sets forth three conditions, =
(2)(A),=20
(2)(B), and (2)(C).<SPAN style=3D"TEXT-TRANSFORM: uppercase"> Code Crim. =

</SPAN>art. 55.01(a)(2) (emphasis added). Paragraph (2)(A) first =
requires that=20
an indictment or information charging the person with committing a =
felony must=20
not have been presented, or if presented, it must have been dismissed or =

satisfied=20
in a misdemeanor case. But (2)(A) contains an additional requirement: =
the=20
limitations period must have expired before the petition was filed. =

paragraph (2)(A)=20
and (2)(A)(i), meaning that both requirements must be met before a party =

are expressly limited to felonies, (2)(A)(i) is not. Because it is not, =

conclude that it applies to misdemeanors as well<SPAN=20

felony indictment or information has yet been presented against Beam, =
but the=20
limitations period for the underlying offense has not expired. =
Therefore, Beam=20
does not satisfy the requirements for filing an expunction petition =
under=20
