MEMORANDUM OPINION
By petition for writ of mandamus, relator, John Patrick Forward, seeks relief
compelling the trial court to provide him with an appellate record free of charge. We deny the petition for
writ of mandamus.

WHEN SHOULD A JUDGE RECUSE?
Recusal is appropriate if a material witness,
a party or related to a party, previously
acted as a party’s attorney, related
to a party’s attorney, prepared any legal
instrument which is in issue, when
personally or financially interested in
the outcome, or determines cannot act
impartially. Recusal is inappropriate to
avoid public clamor, fear or criticism or
political attack.
Under Texas law, a judge must recuse
himself/herself in any proceeding in
which his/her impartiality might reasonably
be questioned. There must be no
doubts or suspicions as to the fairness
or integrity of the court. The judiciary
must strive not only to give all parties a
fair trial but also to maintain a high level
of public trust and confidence.
