Note on Judge's career move: Judge Squier (not Squire) recently resigned his bench to run for
Congress, but is expected to continue hearing divorce cases as a visiting judge. Associate
Judge David
Farr was named by Governor Rick Perry at the end of November 2007 to replace him. Squier is one of ten
candidates competing in the Republican primary to challenge Democratic incumbent Nick Lampson in the
22nd Congressional District. As of December 13, 2007, only one candidate had filed: Attorney
Peter G.
"Pete" Olson, of Sugarland.

Appeal from 312th District Court of Harris County (Judge James D. Squire)
("On November 3, 2006, relator filed a petition for writ of mandamus in this court.  See Tex. Gov't Code
Ann. ' 22.221 (Vernon 2004); see also Tex. R. App. P. 52.  In the petition, relator asked this court to
compel the Honorable James Squire, presiding judge of the 312th District Court of Harris County, to set
aside his ruling denying relator's motion to dismiss for lack of standing. Relator has not established that
he is entitled to mandamus relief.  Accordingly, we deny relator's petition for writ of mandamus.")

Barry v. Barry (Tex.App.- Houston [1st Dist.] Feb. 16, 2007)(Higley)
(
default divorce reversed, restricted appeal, property divisions)
Opinion by Justice Higley (Before Justices Taft, Higley and Bland)
01-05-00551-CV   Dan R. Barry v. Teresa Barry
Appeal from 312th Family District Court of Harris County (Family Law Center -  Houston)
On February 6, 2004, Teresa Barry, appellee, filed for divorce from Dan Barry, appellant. Dan did not file
a response in time, and a default divorce decree was entered. On June 1, 2005, Dan filed a notice of
restricted appeal.
In three points of error, Dan argues that (1) he is entitled to a restricted appeal; (2) the evidence was
insufficient to support the relief granted in the divorce decree; and (3) the division of property was not just
and right. We reverse the judgment of the trial court and remand for a redivision of the marital estate,
including the establishment of the medical obligations for the adult child and apportionment of attorneys’
fees. The motions carried with the case are denied.
