2010 Primary election contest dismissed on standing grounds
In re Baker (Tex.App.- Houston [1st Dist.] Feb. 25, 2010)(Massengale) (petition dismissed for want of
jurisdiction,
contributor to other candidate had no standing to bring election contest)
Baker filed this original proceeding, seeking to have the name of a Republican candidate for judicial
office removed from the primary election ballot.  We dismissed the petition for writ of mandamus for
want of jurisdiction.  We now substitute this opinion for our prior memorandum opinion, explaining our
conclusion that Baker has failed to demonstrate his standing to bring this original proceeding.

Appeals from Cases in Judge Dempster's Court

Niessen Velasco v. Ayala (Tex.App.- Houston [1st Dist.] Nov. 19, 2009)(Higley) (void judgment)
(
motion for new trial, service by publication, service of process on defendant in foreign country)
We conclude that, because Betsabe is a citizen of a Mexico and the record shows that her address in
Mexico was known to Alfonso at the time he sought to effect service on her (which was the same day
he filed his petition containing her address in Mexico), and because Betsabe was not duly served with
citation under the law, the trial court did not acquire personal jurisdiction over her and the trial court’s
judgment is void. We hold that the trial court abused its discretion by failing or refusing to grant
Betsabe’s motion for new trial.

Appeal from 308th District Court of Harris County
Trial Court Judge: Judge Georgia Dempster
Relator asks this court to compel the Honorable Georgia Dempster, presiding judge of the 308th District Court of
Harris County, to vacate those portions of her March 25, 2009 order compelling him to produce documents that
belong to KCO Enterprises, Inc. Relator has not established his entitlement to the extraordinary relief of a writ of
mandamus.  Accordingly, we deny relator's petition for writ of mandamus.

Woodard v. OAG (Tex.App.- Houston [1st Dist.] Mar. 26, 2009)(Alcala)

01-07-00954-CV Victor Jerry Woodard v. Office of the Attorney General
Appeal from 308th District Court of Harris County
Trial Court
Judge: Hon. Georgia Dempster
Appellant, Victor Woodard, appeals from the trial court's judgment in favor of appellees, Trristaan Henry and the Texas
Attorney General. In three issues, Woodard challenges the trial court's jurisdiction, refusal to grant a de novo hearing,
and the factual sufficiency of the evidence to support several rulings concerning child support and possession of his
child. We conclude that the trial court had jurisdiction over this case, and that the trial court erred by denying
Woodard's request for a de novo hearing. We reverse and remand, without addressing the sufficiency of the evidence.

01-07-01001-CV  In The Interest of B.H.G., A Child

The jurisdiction of this Court is invoked by the timely filing of a notice of appeal. In the absence of such, we have no
jurisdiction to hear the appeal, and we have no choice but to dismiss this appeal for lack of subject matter jurisdiction.
